KUCHING, Aug 28 — In a major move to enhance passenger rights, Transport Minister Anthony Loke has announced that airlines will be required to provide full refunds for flights delayed by five hours or more. This new regulation is part of the updates to the Malaysian Aviation Consumer Protection Code 2016 (MACPC) and will be officially gazetted to take effect on September 2, 2024.

In a recent press conference held in Putrajaya, Loke revealed that the amended MACPC will enforce stricter rules to safeguard passenger interests. Airlines will now be obligated to issue full refunds to passengers if their flights are delayed by five hours or more. This refund must be processed using the original payment method, although airlines can also offer alternatives such as credit shells or flight vouchers.

“Passengers will have the flexibility to choose their preferred mode of refund,” Loke stated. “They can opt for a full refund if they decide to cancel their journey due to significant delays.” This move aims to ensure greater accountability from airlines and offer consumers better protection.

Expanded Refund Scope

The new regulations will not only cover flight delays but also extend to various additional charges. Refunds will be mandatory for fuel surcharges, taxes, fees, and charges such as departure levies, passenger service charges, and carbon fees. This applies to both refundable and non-refundable tickets if the flight is not boarded.

“Passengers should be assured that all costs associated with their journey will be refunded if the flight does not take place,” Loke added.
